This is a useful feature if you will be unable to watch live on sale day, have poor cell service/internet connectivity, or just prefer to bid in a relaxed manner without the pressure of a live auction. Pre-bidding works just like eBay! You'll place your maximum bid then sit back and let the computer do the work for you! The computer will only raise your bid incrementally as needed to keep you in the winning position!
PLEASE NOTE that if a horse comes into the ring and an announcement is made or something is visible that was not disclosed in the information that was available to you ahead of time (i.e. - horse is announced to crib, horse is visibly lame, was injured on the trailer, has a large scar that wasn't mentioned, etc) and there are prebids placed on that horse, we WILL NOT honor those prebids for your protection. We want you to bid with confidence and the most accurate information available. No need to send you an unwelcome surprise!

Your card WILL NOT be charged upon registration, but it will be authorized to be sure it is valid. Some mobile banking apps will send you a notification that looks like a charge. DON'T PANIC! We ARE NOT charging you to register as an online bidder - just making sure you are a real person with a working card. This is an unfortunate necessity in this day and time. That preauthorization will NEVER COMPLETE and will fall off like it was never there. It IS NOT a charge! We remove the authorization immediately on our end at the completion of the sale. When it officially falls off on your end is entirely dependent on your bank. (Much like when you rent a car!) You do NOT have to use the card you register with for final payment, and are welcome to pay by cash at pick up!

MIDWAY DRIVING HORSE
SALE TERMS AND CONDITIONS OF CONSIGNOR’S CONTRACT
BY ENTERING AN ANIMAL OR ANIMALS IN ANY SALE CONDUCTED BY THE MIDWAY DRIVING HORSE SALE (MDHS) AND THE CONSIGNOR OR HIS/HER AGENT SIGNING THIS ENTRY. THE CONSIGNOR DOES THEREBY AGREE TO THE FOLLOWING TERMS AND CONDITIONS.
NO PRIVATE SALE/WITHDRAWAL FROM SALE. The Consignor agrees that after having consigned the animal to the sale of M.D.H.S. he/she will not dispose of it by private sale, either prior to or during the progress of sale, or at any time the animal is on the sale grounds and consignor hereby contracts to pay a penalty of $275.00, to MDHS, if this agreement is violated. Consignor also agrees that no animal will be withdrawn from the sale, except in case of injury or sickness, subsequent to the time of entry, sufficient in nature to prevent realizing a fair price.
RISK OF LOSS. The animals consigned to MDHS for sale are entirely at the risk of the CONSIGNOR until sold and fully paid for. MDHS. will not at any time take title to, or have any responsibility for, the animals consigned to MDHS sale.
WARRANTIES OF CONSIGNOR. CONSIGNOR warrants title to each animal (including foals and foals in utero) free of any liens or encumbrances and agrees to defend title against all claims. CONSIGNOR warrants all information set forth herein regarding pedigrees, identity and engagements are true, correct and complete. CONSIGNOR warrants that no animal that is suffering from contagious disease or is unsafe or vicious will be sent to the sale. CONSIGNOR acknowledges that CONSIGNOR is solely responsible for all information provided herein.
IDEMNIFICATION. CONSIGNOR agrees to defend, indemnify and hold harmless MDHS, its’ members, agents, employees, successors and assigns from and against all losses, damages, liabilities, obligations, claims, actions, suits, proceedings, demands, judgments, assessments, fines, interest, penalties, costs, and expenses (including without limitation, settlement costs and reasonable legal, account, expert’s and other fees, costs and expenses) incident to or related to this Consignor’s Contract, these Terms and Conditions, any transaction contemplated hereby, any representations or warranties of Consignor including any matters related to the title pedigree condition, identity or engagement of any animal, the placement for sale of any animal of Consignor, or otherwise related to or arising from any action or omission of Consignor, consignor’s agents, employees, officers, or assigns, or any animal consigned to MDHS for sale.
REFUSAL OF ENTRY. MDHS reserves the right to refuse any animal consigned for sale in its sole discretion for any reason or no reason.
PRESENCE OF CONSIGNOR. The Consignor agrees that he/she will be present in person, or have a duly authorized representative present, to make statements regarding each animal. MDHS disclaims responsibility for errors and/or omissions by Consignors or their agents and errors and/or omissions in catalog.
CONDUCT OF SALE. MDHS is authorized to decline any bid by any person in its’ sole and absolute discretion, but not limited to, bids by intoxicated or disorderly parties, those who have defaulted on former purchases, or any person who MDHS believes is not a reliable or responsible party. In case any purchaser fails to pay for and receive an animal struck down to him.
TERMS OF COMMISSION. (1) A $75.00 consignment fee must accompany each entry. (2) The agreed upon commission will be deducted from the consignor’s payout. The Consignor may buy back their animal but will be responsible for all commissions. There will be no exceptions. In the event of default of payment of this debt, the debtor will be responsible for all costs relating to professional collection, such as collection fees, attorney fees, interest and court costs. NO ADVERTISING WILL BE DONE ON ANY CONSIGNMENT UNTIL ALL CONSIGNMENT FEES ARE PAID IN FULL.
SETTLEMENT WITH CONSIGNOR. MDHS will settle with Consignor for property sold within 3 days of the sale as it requires time to make up accounts and straighten up settlements with purchasers, and the like, following the sale of property or animals.
ATTORNEY’S FEES. MDHS shall be entitled to attorney’s fees incurred in the enforcement of this Consignor’s Contract or any of these Terms and Conditions.
EIA AND HEALTH CERTIFICATES. Per Indiana regulation, an Equine Infectious Anemia (EIA) test taken twelve (12) months prior to sale is required. Any animal shipped to MDHS without a proper EIA test will be quarantined at the Consignor’s expense until property negative EIA test is acquired. For animals entering Indiana, a certificate of veterinary inspection is also required, stating that examination was made within the past thirty (30) days and revealed the animal to be free from any sign of contagious or infections disease. All DNA papers, where applicable, must be in order. HEALTH PAPERS, COPY OF EIA (COGGINS) TEST, MUST BE IN THE SALE OFFICE PRIOR TO SALE.
Hay, Bedding and Feed. All consignors are responsible for their own feed and hay. First bedding will be provided, additional bedding is available for purchase.
Guarantees. No guarantees whatsoever, expressed or implied, are made by the sale committee, the auctioneers, pedigree readers, bid spotters, or anyone associated with the MDHS, as to title, quality, unsoundness or soundness of any consignments. Presentations given in writing by the consignor to the sale committee will be announced at the time of sale as though by the consignor. Any claims made based upon said presentation, guarantees, or omissions, shall be made against the consignor only and not the sale committee or any persons related to the sale. Seller’s statements of soundness or unsoundness will be announced at the sale.
NON-SALE HORSES. There will be a stall fee of $75.00 for all transit horses Contact sales management for availability of stalls.
SALES TAX. All sales will be charged 7% sales tax per the requirements of the State of Indiana.
TERMS OF SALE. Horse Sales - Payment Options: Cash or Check. All consignments must have a new halter and lead rope, otherwise the sale committee will supply one and charge the seller for the cost. No horse will be allowed to leave the grounds without a checkout slip indicating full payment. All horses must be removed from the barns by 7:00 p.m. Friday evening, the last day of the sale unless other arrangements are made with the sale committee.
INTERNET BIDDERS PLEASE NOTE! When you register to bid, Prime Choice Auctions will place a $1000 preauthorization on the credit or debit card that you register with. This is NOT a charge, just a preauthorization. Your mobile banking may send a notification that appears as a charge - AGAIN, it is just a preauthorization. The $1000 will show as "pending" and then never complete but rather, will just vanish as if it was never there. Once the sale is complete, this preauthorization is released for all non-winning bidders. Winning bidders will have the preauthorization lifted once final settlement is made with the auction company. If for any reason you as a winning bidder fail to make final payment to the auction company before the open of business on Monday, you understand that Prime Choice Auction will finalize the $1000 preauthorization and remit it to the auction company to be applied to your bill. Further, you understand that Prime Choice Auctions will charge your registered card for the full amount due to the auction company for your winning bids. BID RESPONSIBLY and remember, your bid is a legally binding contract! You are responsible for your winning bids.
